Introduction|引言
As the Book of Songs (Shijing), “Chi Xiao” (Owl) cautions, preparation should begin before the storm arrives—not when the well has run dry and it is already too late to dig.
《诗经·豳风·鸱鸮》有言:“迨天之未阴雨……绸缪牖户。”其意在告诫世人:真正有效的准备,发生在风险尚未显形之前——而非等到“临渴”之时才仓促“掘井”。
In today’s global environment, this ancient insight feels unusually contemporary. Supply-chain disruptions, geopolitical frictions, competition over critical minerals, and concerns over energy security have become recurring features rather than exceptional events. Resources are increasingly treated not only as market commodities, but also as strategic assets tied to national security, industrial continuity, and macroeconomic stability.

Against this backdrop, on 17 January 2026, China’s National Development and Reform Commission released the Draft National Reserve Security Law (Public Consultation Draft) (the “Draft”) for public comment. As a consultation draft, its provisions remain subject to revision prior to formal enactment and the issuance of implementing rules. However, from a structural perspective, the Draft can be read as less about a single short-term market fluctuation and more about constructing an institutional framework designed to operate under sustained uncertainty. In this sense, it can be read as part of a broader global trend in which resource security is increasingly being formalised as a core component of state governance.
在这一背景下,中国国家发展改革委于2026年1月17日公布《中华人民共和国国家储备安全法(草案,征求意见稿)》(以下简称“草案”),并向社会公开征求意见。作为征求意见稿,其具体条款在正式出台及配套实施细则明确前,仍存在调整空间。但从制度结构的角度看,该草案的关注重点并非针对某一次短期市场波动,而更倾向于构建一套能够在长期不确定性环境中运行的制度框架。就此而言,草案亦可被视为一种更广泛趋势的组成部分——即资源安全正逐步被制度化,并纳入国家治理的核心议题之中。
I. Draft Highlights and Structural Interpretation|草案要点速览与解读
Below, we summarise the Draft across four layers—system, tools, constraints, and implementation—based strictly on the Draft text.
以下按“制度—工具—约束—落地”四个层级,提炼草案的关键点与含义(均以草案原文为准):
1. The scope is structurally expanded: from “warehouses” to “systems”
Broader coverage: food/agricultural products and inputs, energy, mineral raw materials, critical equipment and components, emergency supplies, etc., with a formal distinction between physical reserves and capacity reserves (Art. 2, Art. 5).
Clearer governance objectives: a triad of strategic assurance, macro stabilisation, and urgent-need response (Art. 4).
Implication: the policy focus shifts from “how much to store” to “whether production and delivery can be sustained under shock.” For critical minerals, stockpiling alone is insufficient; refining/separation capacity, substitution pathways, mobilisable capacity, and logistics enter the legal frame.
1. 国家储备的外延被系统化扩展:从“仓库”到“体系”
覆盖范围更广:粮食农产品及其投入品、能源、矿产品原材料、重要装备和零部件、应急专用物资等,并区分实物储备与能力储备(第2条、第5条)。
治理目标更清晰:战略保障、宏观调控、应对急需三位一体(第4条)。
含义:政策关注点不只在“存多少”,而是“能否在冲击下维持生产与交付”。对关键矿产而言,单纯囤货不足以覆盖风险;冶炼分离能力、替代材料路线、产能动员与物流保障被纳入制度视野。
2. A layered reserve structure is proposed: government-led, enterprise and society as complements
Proposed categories: government reserves (central/local), enterprise reserves (including social-responsibility reserves, other policy reserves, operating inventories), and social-unit reserves (organisations/communities/households) (Art. 5).
Enterprise obligations encouraged/introduced: businesses are encouraged to build reserves; “enterprise social responsibility reserves” are introduced in areas including food, energy, mineral resources, and salt (Art. 12).
Implication: “national reserves” move from a single-agency responsibility towards a broader governance ecosystem. For the resource sector, two effects are likely: First, compliance expectations may extend into corporate inventories and supply-chain management (especially for designated enterprises); Second, warehousing, quality, reporting, and drawdown cooperation may take on quasi-public characteristics.
2. 多层次储备结构被制度化提出:政府为主、企业与社会补充
明确分类:政府储备(中央/地方)、企业储备(含社会责任储备、政策性储备、经营库存)、社会单元储备(单位/社区/家庭)(第5条)。
企业责任被鼓励/提出:鼓励经营主体建立企业储备,并在粮食、能源、矿产资源、食盐等领域提出企业社会责任储备安排(第12条)。
含义:草案将“国家储备”从行政部门的单点责任,拓展为更广泛的治理生态。对资源行业而言,可能带来两点变化:其一,合规要求可能外溢到企业库存与供应链管理(尤其是被纳入社会责任储备/政策性储备的企业);其二,企业的仓储、质量、信息报送与动用配合更趋“准公共性”。
3. A “harder” toolkit: temporary procurement, requisition, drawdown, and cross-regional coordination
Temporary procurement (Art. 18): for vital materials, temporary stockpiling may be approved; for major emergencies, the government may undertake state-backed procurement.
Requisition (Art. 15): for national security interests, the state may requisition materials pursuant to law with fair and reasonable compensation.
Drawdown triggers (Art. 36): supply shortfalls/disruptions/abnormal price swings, major disasters/incidents, significant national security threats, etc.
Implication: the Draft reserves higher-intensity interfaces for non-routine shocks. For critical minerals, the design aims to enable rapid transition into an emergency operating mode in response to supply cuts, extreme volatility, or security events.
3. 工具箱更“硬”:临时性收储、征收、动用与跨区协同
临时性收储(第18条):关系国计民生重要物资,经批准可开展临时收储;重大突发事件可实施政府兜底式收储安排。
征收条款(第15条):基于国家安全利益需要,国家可依法征收物资并给予公平合理补偿。
动用触发条件(第36条):供不应求/供应中断/价格异常波动、重大灾害事故、国家安全面临重大现实威胁等。
含义:草案为“非常态冲击”预留更高强度的政策接口。对关键矿产而言,这类条款的意义在于:一旦出现外部断供、价格剧烈波动或安全事件,储备体系可更快切换到应急运作逻辑。
4. Sharper enforcement is contemplated: digitisation, credit-related sanctions, and compulsory measures
Stronger reporting and system integration (Art. 31, Art. 48).
Credit-record sanctions for violations (Art. 49).
Higher penalties and prohibitions for misreporting, unauthorised drawdown, substitution/mixing, using reserve goods as collateral/for delivery, extracting spreads/subsidies, etc. (Art. 52, etc.).
4. 监管与处罚力度显著上台阶:信息化、信用惩戒、强制措施
强化信息调查统计与报告制度、信息系统接入(第31条、第48条)。
将违规行为纳入信用记录与失信惩戒(第49条)。
对虚报瞒报、擅自动用、串换混存、以储备物资担保/交割、套取差价补贴等设置更高强度的罚则与禁入(第52条等)。
II. Comparison with U.S. Institutional Frameworks|美国相关制度对比
The United States does not operate a single, unified statute that is directly equivalent to China’s Draft National Reserve Security Law. Instead, it relies on an institutional “portfolio” that collectively performs similar functions—combining (i) emergency stockpiles for specific critical items, (ii) legal authorities for industrial mobilisation and prioritisation, and (iii) specialised strategic materials management. Read as a whole, this U.S. mix serves as a functional analogue to the Draft’s integrated approach, even though it is distributed across agencies and legal instruments.
美国并不存在一个与该草案直接对应、统一成文的“国家储备综合立法”。其相近功能更多由一套“制度组合”共同实现:一方面,对特定关键品类设置应急库存;另一方面,通过法律授权实现工业动员与优先保障;同时,对战略关键材料建立专项管理与储备机制。若将这三类制度作为整体观察,它们在功能上可视为对草案“综合安全体系”思路的一种分散式对应——只是分布在不同部门与不同法工具之中。
This comparison does not imply institutional equivalence. Rather, it highlights how different legal systems have adopted converging governance tools to address similar resource-security challenges.

1. Functional mapping: what the U.S. mix covers versus China’s Draft
China’s Draft seeks to formalise a broad, integrated reserve-and-mobilisation system spanning:
physical reserves + capacity reserves (and related technology/logistics arrangements);
multi-layer governance (central/local government + enterprises + society);
non-routine “shock mode” tools (temporary procurement, requisition, drawdown, cross-regional coordination);
tighter supervision and liability (digitisation, reporting, inspections, penalties, and credit sanctions).
The U.S. institutional mix, taken together, covers comparable functional pillars, but through separate regimes:
SPR (Strategic Petroleum Reserve) focuses on a single critical commodity (emergency crude oil) with mature drawdown operations;
DPA (Defence Production Act) provides standing authorities to prioritise and allocate orders and to incentivise/expand industrial capacity (treating capacity as mobilisable national capability);
NDS (National Defence Stockpile) maintains strategic and critical materials stockpiles to reduce foreign dependence and support defence readiness.
1. 功能映射:美国制度组合与草案覆盖面
中国草案试图把“储备 + 动员”以综合方式制度化,覆盖:
实物储备 + 能力储备(并将技术、物流等纳入同一安全框架);
多层次治理(中央/地方 + 企业 + 社会单元);

更高强度的监督与责任(信息化、报送、检查、处罚与信用惩戒等)。
将美国相关制度作为整体看,其功能支柱与上述方向具有对应性,但通过分散制度实现:
SPR(战略石油储备):聚焦单一关键品类(应急原油),动用机制更成熟、路径更清晰;
DPA(国防生产法):提供优先履约与资源分配等常设授权,并通过激励工具扩张关键产能,将“产能”视为可动员的国家能力;
NDS(国家国防储备):围绕战略关键材料建立库存管理,以降低对外依赖并服务国防准备。
2. Central difference: integrated statute vs. distributed governance
A key structural difference is that China’s Draft attempts to unify system objectives, reserve categories, mobilisation tools, and enforcement mechanisms into a single legislative framework. By contrast, the U.S. approach is distributed: energy emergency buffering (SPR), capacity mobilisation (DPA), and strategic materials stockpiling (NDS) sit in distinct institutional lanes, each with its own operational logic and governance arrangements.
The practical implication is not simply “broad vs narrow,” but “integrated vs modular.” The Draft reads like a single architecture intended to coordinate multiple reserve forms and actors; the U.S. mix functions more like modular components that can be activated under different circumstances and authorities.
2. 核心差异:综合立法 vs. 分散治理
一个关键结构差异在于:草案试图在一部法律内,统筹目标、储备类别、动员工具与监管责任,形成统一架构;而美国的做法更偏“模块化分工”:能源应急缓冲(SPR)、产能动员与优先保障(DPA)、关键材料专项库存(NDS)分属不同制度轨道,各自拥有独立的治理结构与运行逻辑。
因此,差异并非简单的“范围大/小”,更是“综合协调 vs 模块组合”。草案呈现为一个试图统筹多类型储备与多主体协同的单一架构;美国制度组合则更像若干可在不同情形下被分别启用的制度模块。
3. Convergence in logic: from market goods to security capability
Despite structural differences, the underlying policy logic shows convergence. In both systems, certain items—energy, strategic materials, and critical supply-chain inputs—are progressively treated less as ordinary market goods and more as security-relevant capabilities. The Draft makes this explicit by placing capacity/technology/logistics alongside physical stock; the U.S. mix expresses it through the division of labour: SPR buffers supply shocks, DPA mobilises/expands capacity, and NDS reduces strategic dependence.
3. 底层逻辑趋同:从市场商品到安全能力
尽管结构不同,但底层逻辑呈现趋同:在两种体系中,能源、战略材料与关键供应链投入品等,越来越不被视作纯粹市场商品,而被纳入“安全能力”的治理范畴。草案通过将产能/技术/物流与实物并列使这一点更显性;美国制度组合则通过功能分工体现:SPR负责缓冲供应冲击,DPA负责动员与扩张产能,NDS负责降低战略依赖。
III. Reading the Long-Term “Resources as Power” Trend|从法规演变看“资源为王”的长期趋势
Reading China’s Draft alongside the U.S. institutional mix suggests at least three longer-horizon, observable policy directions (noting that implementation will depend on final texts and practice).
结合草案与美国的制度组合,可观察到至少三条更长期、可验证的政策方向(具体仍以最终文本与执行实践为准):
1. From price management to resilience governance
The Draft emphasises livelihoods, industrial development, and market stability (Art. 4), and calls for optimising categories, scale, structure, and geographic layout (Art. 3, Art. 11). The underlying shift is that, for critical items, system continuity increasingly takes priority over price optimality. This aligns directionally with objectives implicit in the SPR (buffering supply shocks) and the DPA (industrial mobilisation).
1. 资源治理从“价格管理”转向“韧性治理”
草案强调储备聚焦国计民生、产业发展、市场稳定(第4条),并要求统筹品类、规模、结构与布局(第3条、第11条)。其背后意味着:在关键品类上,“系统可持续运转”正逐步被置于“价格最优”之前。这一逻辑与SPR(缓释供应中断冲击)、DPA(工业动员)的目标具有方向上的可比性。
2. Inventory and capacity/technology converge into a single class of national capability
By placing capacity reserves, origin reserves, technology reserves, and logistics alongside physical reserves (Art. 5, Art. 31), the Draft implies that “reserves” live not only in storage, but also in factories, mines, laboratories, and transport networks. For critical minerals, refining/separation capacity, substitution pathways, and recycling systems increasingly resemble mobilisable capabilities—directionally similar to DPA-style capacity incentives.
2. “库存”与“产能/技术”正在合并为同一类国家能力
草案把产能储备、产地储备、技术储备、物流保障与实物储备并列(第5条、第31条),意味着储备不只在仓库,也在工厂、矿山、实验室与运输网络里。对关键矿产而言,“冶炼分离能力、替代材料路线、回收体系”更接近可动员能力,这与DPA通过激励工具强化供给侧韧性的路径在方向上相近。
3. Reserve governance enters a higher-intensity compliance era
The Draft contemplates dense supervisory powers and liabilities—on-site inspection, document access/copying, sealing/seizure, account inquiries, interviews (Art. 47), combined with credit-record sanctions (Art. 49) and substantial penalties (Art. 52, etc.). Over time, this may normalise a new baseline: enterprises participating in the reserve system may need to embed reserve-performance capability into governance and internal control; storage safety, quality inspection, reporting, drawdown cooperation, and accounting discipline become core compliance domains. Sector competitiveness may increasingly hinge on compliance capability, supply-chain transparency, and risk management—not only output and cost.
3. 储备治理正在进入“高强度合规时代”
草案的监管手段与法律责任条款密集:现场检查、查阅复制、查封扣押、查询账户、约谈询问(第47条),并配合信用惩戒(第49条)与高额罚则(第52条等)。长期看,这会推动形成新常态:参与储备体系的企业,需要将“储备履约能力”纳入治理与内控;仓储安全、质量检验、信息报送、动用配合、资金与账务规范将成为关键合规模块。资源行业的竞争力将越来越依赖“合规能力 + 供应链透明度 + 风险管理能力”,而不仅是产量与成本。
Conclusion|结语
Although the Draft may be amended prior to enactment, a shared direction is visible when read alongside the U.S. institutional mix (SPR, DPA, and NDS) and the design logic embedded in China’s Draft: critical resources are increasingly framed as security concerns, recast as strategic assets, and operationalised as mobilisable capabilities. In an era of supply-chain reconfiguration and more frequent geopolitical shocks, “resources as power” is not merely a slogan; it is increasingly encoded into policy toolkits and operational governance capacity.
尽管草案内容可能会在正式公布前作些许调整,但从美国SPR、DPA与NDS等制度组合到中国《国家储备安全法(草案)》的制度设计,仍可观察到一个共同方向:关键资源正在被持续纳入“安全议题”框架,被重塑为战略资产,并进一步转化为可动员的能力形态。在供应链重构与地缘冲击更频繁的时代,“资源为王”并非口号,而是逐步被写入制度工具箱、转化为可操作的治理能力。
For enterprises, proximity to national reserve systems increasingly brings both opportunity and constraint. Participation may enhance operational certainty, but also raises expectations around compliance, transparency, and delivery capacity. Over time, competitive advantage in resource-related industries is likely to depend not only on cost and scale, but also on governance capability and institutional alignment.
对企业而言,越接近国家储备体系,机遇与约束往往同步增强。一方面,制度嵌入有助于提升经营确定性;另一方面,也对合规能力、信息透明度与履约水平提出更高要求。长期来看,资源相关行业的竞争力,或将越来越取决于治理能力与制度适配度,而不仅是成本与规模。
